ROLECE (Španělsko) — Registr uchazečů a klasifik.

What the register is for

The Registro Oficial de Licitadores y Empresas Clasificadas del Sector Público exists to record the data and circumstances relevant to proving an economic operator's fitness to contract with the Spanish public sector, including the powers of its representatives and attorneys, and to make that provable before any contracting body (art. 337.1 of Ley 9/2017, LCSP). It depends on the Ministerio de Hacienda y Función Pública and is kept by the technical support bodies of the Junta Consultiva de Contratación Pública del Estado.

Two things are entered automatically. Classifications granted by the state classification commissions, and by regional bodies where these do not contradict the state ones, are inscribed ex officio (art. 338.1), as are prohibitions on contracting under art. 73.2 (art. 338.2). Everything else is entered at your request: legal personality and capacity to act, the extent of your representatives' powers, professional authorisations and habilitations, and economic and financial solvency data (art. 339.1). Article 342 makes inscription voluntary, and lets you choose which of those data are recorded.

What inscription actually proves

Article 96.1 is the operative provision. Inscription in ROLECE proves, before all public sector contracting bodies and unless the contrary is shown, the operator's conditions of fitness as to personality and capacity to act, representation, professional or business habilitation, economic and financial solvency, technical or professional solvency, classification and the other circumstances entered, together with the presence or absence of prohibitions on contracting. Article 340.3 confirms that all entries have the same accreditative effect regardless of which authority made them.

Powers of attorney get special treatment. ROLECE is interconnected and interoperable with the state electronic register of powers; contracting bodies must consult ROLECE to verify powers and, where a power appears in more than one register, the ROLECE entry prevails (art. 337.4).

Where the effect stops

Regional registers are not a superset. Autonomous communities may keep their own registers of bidders and classified companies (art. 341.1), and inscription in one proves your data before that community's contracting bodies, the local entities in its territory, and bodies dependent on either (arts. 341.3 and 96.2). It does not travel. If you bid across regions, a regional entry alone will not carry you into a state procurement or another community's.

Nor does inscription replace the contract. It proves the general facts; the pliego for a specific contract may demand solvency above what you have registered, and anything not held in the register still has to be produced when the contracting body issues its documentation request (art. 150.2). In the simplified open procedure, art. 159.4 expressly requires the bidder to supply, within the seven working days allowed for the definitive guarantee, any document not inscribed in the register.

Registration also carries a live duty. Article 343 obliges registered operators to notify any change to their recorded data and any supervening circumstance amounting to a prohibition on contracting. Failure to do so, with intent or negligence, can lead to suspension of the inscription and of its effects for public procurement, and of the right to have certificates issued.

When it stops being optional

Article 159.4.a) makes ROLECE compulsory in the procedimiento abierto simplificado: every bidder must be inscribed in ROLECE, or in the register of the relevant autonomous community where art. 96.2 applies, by the final date for submitting offers. There is one relief valve. An offer is also admissible if the bidder proves it filed its application for inscription, with the required documentation, before that date — evidenced by the register's acknowledgement of receipt plus a responsible declaration that the documentation was filed and that no request for correction has been received.

The simplified open procedure covers works up to €2,000,000 of estimated value and supplies and services below the harmonised thresholds for central state bodies, so this captures a large share of routine Spanish tendering. In practice, an unregistered supplier is locked out of that whole procedure type.

What to do about it

Start the registration before you find a tender worth bidding for. Inscription is applied for electronically and requires a qualified electronic certificate for the person acting, and the slow parts are the corporate documents and the evidence of the signatory's powers — not the form. A supplier that discovers the art. 159.4 requirement two weeks before a deadline is relying on the acknowledgement-of-receipt relief valve, which works only if the filing is complete.

Register your representatives' powers deliberately. Because ROLECE prevails over other registers of powers, an out-of-date entry is worse than none: it is the version the contracting body will act on.

Choose your register with the geography of your pipeline in mind. If you sell only to one autonomous community and its local authorities, the regional register may be enough. If your pipeline crosses regions or includes central government, you want ROLECE, and you should keep the data current rather than fixing it under a seven-day deadline after you have already won.
