Decreto 1082 de 2015 — Colombia's single regulatory decree for procurement
Decreto 1082 de 2015 is the single regulatory decree of the National Planning sector, and its Book 2, Part 2, Title 1 carries the operating mechanics of Colombian public procurement. The statute says what the modalities are; this decree says how each one runs, what documents must exist, and when. It is also amended constantly, so the article you read last year may not be the article in force.
What it is
Colombia compiles its regulations sector by sector into a single decree each. Decreto 1082 de 2015 is the one for the Sector Administrativo de Planeación Nacional, and public procurement sits inside it at Book 2, Part 2, Title 1 — the articles numbered 2.2.1.x.
The decree did not invent those rules. Most of them came from Decreto 1510 de 2013, and the consolidated text still carries the origin note at the foot of each article, so you can see where a provision came from. What Decreto 1082 did was put them all in one place, and it is now the document that a Colombian buyer and a Colombian bidder both work from.
The articles that matter to a bidder
Definitions sit at 2.2.1.1.1.3.1 and are load-bearing. Acuerdos Comerciales, Bienes Nacionales, Servicios Nacionales, Documentos del Proceso, Entidad Estatal and Proceso de Contratación are all defined here, and the definitions do real work later — the rule of origin for Servicios Nacionales, for example, decides whether a foreign bidder gets the national-industry points.
The RUP is governed by subsection 2.2.1.1.1.5: registration, renewal and cancellation at 2.2.1.1.1.5.1, the information to be filed at 2.2.1.1.1.5.2, the habilitantes the chambers of commerce verify at 2.2.1.1.1.5.3, and the content of the certificate at 2.2.1.1.1.5.6.
Publication is at 2.2.1.1.1.7.1: the entity must publish the Documentos del Proceso and the administrative acts in SECOP within three days of issuing them; only the winning offer is published; commodity-exchange operations are exempt.
Prior studies are at 2.2.1.1.2.1.1, the aviso de convocatoria at 2.2.1.1.2.1.2, and the compulsory contents of the pliego de condiciones at 2.2.1.1.2.1.3 — fourteen items, including the classification code, the tie-break factors, the grounds for rejecting an offer, the risk allocation, the deadline within which adendas may be issued, and whether the process is covered by a trade agreement.
Comment windows are at 2.2.1.1.2.1.4: interested parties may comment on the draft pliego for ten business days in a licitación pública, and five business days in a selección abreviada or concurso de méritos. This is the cheapest intervention available to a bidder and the one most often skipped.
The modalities occupy Chapter 2: licitación at 2.2.1.2.1.1, selección abreviada at 2.2.1.2.1.2 (including the framework-agreement articles), concurso de méritos at 2.2.1.2.1.3, contratación directa at 2.2.1.2.1.4, and mínima cuantía at 2.2.1.2.1.5.
Trade agreements and incentives are at 2.2.1.2.4.1.3 and 2.2.1.2.4.2.x — national treatment, the national-industry score, calls limited to Mipymes, and the tie-break rules.
The churn problem
Decreto 1082 is amended more often than any other instrument a Colombian bidder deals with. The consolidated text carries amendment notes from, among others, Decreto 399 de 2021, Decreto 680 de 2021, Decreto 1279 de 2021, Decreto 1860 de 2021, Decreto 1041 de 2022, Decreto 142 de 2023 and Decreto 0287 de 2026. Individual articles have been rewritten more than once.
The consequence is practical. A pliego, a checklist or a summary that quotes 2.2.1.1.2.1.1 or 2.2.1.2.1.5.2 may be quoting a repealed version. Both of those articles have been replaced since 2015.
What to do about it
Read the article, not a summary of it, and read it in a consolidated source that shows the amendment notes. The Gestor Normativo maintained by the Departamento Administrativo de la Función Pública publishes Decreto 1082 with the modifying decree named at the foot of each amended article; that note is the fastest way to tell whether what you are reading is current.
Work backwards from the modality. Once you know whether a process is a licitación, a selección abreviada, a concurso de méritos, a mínima cuantía or a direct award, the relevant subsection of Chapter 2 tells you the sequence, and Chapter 1 tells you what documents must exist and when they must be published.
And use the comment windows at 2.2.1.1.2.1.4. Ten business days on a draft pliego is the only point at which the specification is still cheap to change; after the acto de apertura, your leverage is limited to observaciones on an evaluation report you have already lost.
