Commission des Soumissions — Commission of Bids, Luxembourg
A consultative commission instituted at the Ministry of Mobility and Public Works that examines procurement complaints and issues non‑binding opinions to contracting authorities in Luxembourg.
Role and composition
The Commission des Soumissions is established within the Ministry of Mobility and Public Works. It is composed of nine members: five (including the president) representing the contracting authorities and four representing the professional chambers; for each member a designated alternate is named.
Functions and limits
Its missions include ensuring legal, regulatory and contractual compliance by contracting authorities and contractors, instructing complaints and carrying out consultative tasks. The Commission gives opinions at the request of a contracting authority on proposed procedures, exclusions, cancellations or termination matters; its opinions are consultative and do not bind the contracting authority.
Practical consequence for suppliers
There is no mandatory form to seize the Commission, though two recommended saisine forms are provided. Dossiers should be transmitted to the Commission’s secretariat preferably at least seven days before meetings; queries and requests for opinion can be sent electronically to commission.soumissions@mmtp.etat.lu.
