Rammeaftale (Framework agreement) — Denmark

Rammeaftale (framework agreement) — a Danish public procurement contract form that fixes terms (price, quantity) for multiple future contracts during a defined period, often procured through an EU tender.

What it does

A rammeaftale is a continuing agreement between one or more ordregivere (contracting authorities) and one or more suppliers that fixes terms for contracts during a defined period, notably price and quantity. When the estimated total value of purchases that may be made under the framework exceeds the relevant thresholds, the framework must be sent to EU tender and is regulated by the udbudslovens provisions on frameworks. Once the framework has been awarded, individual contracts under it can be concluded without a new EU procurement procedure.

A framework may be established with a single supplier or with several suppliers. If several suppliers are appointed, the procurement documents must set out how specific contracts will be awarded under the framework, for example by direkte tildeling (direct award) under the framework terms or by genåbning af konkurrencen (miniudbud).

Practical consequence for a supplier

Suppliers must bid in the initial framework procurement to be appointed. Only suppliers appointed to the rammeaftale are eligible to receive direct awards or to be invited to miniudbud. New contracting authorities or new companies cannot join an existing framework after award.
