From the supplier’s perspective, the subject matter of the procurement does not change as a result of the above-mentioned modification, since the supplier has still been required to offer two electrically powered cremator furnaces (1+1).Accordingly, the procurement will be carried out in compliance with the terms and conditions set out in the original invitation to tender and its appendices. Therefore, the contracting authority is entitled to carry out a direct procurement pursuant to Section 40(1)(1) of the Procurement Act.
