Nabavka naftnih derivata Dizel gorivo (EN 590) /Procurement of petroleum products – Diesel Fuel (EN 590)

Razlog hitnosti za skraćenje roka za podnošenje ponuda je obaveza naručioca da sprovede ovaj postupak nabavke u 2025. godini radi ispunjenja mjerila za zatvaranja pregovora o poglavlju 15 energetika (formiranje obaveznih rezervi naftnih derivata saglasno Direktivi 2009/119/EC). Naručilac nije mogao uticati na to da se ova nabavka sprovede ranije, jer skladišni kapaciteti u Crnoj Gori, bilo u svojini države bilo u privatnoj svojini, nisu bili raspoloživi, a osiguranje skladišnih kapaciteta je ključan preduslov za pokretanje postupka nabavke goriva. Naručilac je zaključio Ugovor o skladištenju 04. decembra 2025. godine. Vlada Crne Gore je radi povećanja sigurnosti snabdijevanja Akcionim planom formiranja obaveznih rezervi naftnih derivata koji je donijela 26. decembra 2024, godine i Godišnjim planom formiranja i oržavanja obaveznih rezervi naftnih derivata za 2025. godinu Uprave za ugljovodnike koji je Vlada donijela 31. jula 2025. godine prioritetizovala skladištenje obaveznih rezervi naftnih derivata u Crnoj Gori u odnosu na skladištenje u inostranstvu. Naručilac nije mogao uticati na raspoloživost skladišnih kapaciteta na teritoriji Crne Gore a koji su u privatnoj svojini, jer je resorno ministarstvo u Grčkoj odobrilo čuvanje obaveznih rezervi Jugopetrola u Grčkoj tek u novembru 2025. godine, a dotad je Jugopetrol kao zakonski obaveznik formiranja dijela obaveznih rezervi morao skladišti svoje obavezne rezerve isključivo na naftnom terminalu u luci Bar. Pored toga, naručilac nije mogao uticati niti na raspoloživost skladišnih kapaciteta u svojini države, jer njihova obnova koju sprovodi ministarstvo nadležno za energetiku još uvijek nije ugovorena, iako je početak radova bio planiran za prvi kvartal 2025. godine. /he reason for the urgency and the shortening of the deadline for submission of bids is the contracting authority's obligation to conduct this procurement procedure in 2025 in order to fulfil the criteria for closing the negotiations under Chapter 15 - Energy (establishment of mandatory reserves of oil products in accordance with Directive 2009/119/EC). The contracting authority was not in a position to initiate this procurement earlier, as storage capacities in Montenegro, whether in state ownership or private ownership, were not available, while the securing of storage capacity constitutes a key precondition for commencing the fuel procurement procedure. The contracting authority concluded the Storage Agreement on 4 December 2025. For the purpose of enhancing security of supply, the Government of Montenegro, by adopting the Action Plan for the Establishment of Mandatory Oil Product Reserves on 26 December 2024, and the Annual Plan for the Establishment and Maintenance of Mandatory Oil Product Reserves for 2025 of the Hydrocarbons Administration on 31 July 2025, prioritised the storage of mandatory oil product reserves within Montenegro over storage abroad. The contracting authority could not influence the availability of storage capacities on the territory of Montenegro held in private ownership, since the competent ministry in Greece approved the storage of Jugopetrol's mandatory reserves in Greece only in November 2025. Until that time, Jugopetrol, as a statutory obligor for forming a portion of the mandatory reserves, was required to store its mandatory reserves exclusively at the oil terminal in the Port of Bar. Furthermore, the contracting authority could not influence the availability of storage capacities owned by the state, as their refurbishment, implemented by the ministry responsible for energy, has not yet been contracted, notwithstanding that the commencement of works had been planned for the first quarter of 2025.
